Terms and Conditions of Service

1. Parties

This agreement is entered into between IBEROMEXICANA Q.ROO, S. DE R.L. DE C.V. (RFC: IQR160106N51), trading as Caribbean Assistance ("Caribbean Assistance", "we", "us"), and the individual or legal entity contracting the service ("the Customer", "you"), in accordance with the Mexican Commercial Code, the Federal Consumer Protection Law (LFPC), and other applicable regulations.

2. Service Description

Caribbean Assistance acts as a distribution and management channel for assistance plans operated by All Assist. Upon contracting a plan, Caribbean Assistance:

  • Receives payment and manages the commercial relationship with the Customer.
  • Registers the Customer as an affiliate on the All Assist platform.
  • Issues an internal policy number in the format CA-XXXX-XXXX.

Medical, legal, roadside, funeral, and pet assistance services are delivered directly by All Assist and its provider network, not by Caribbean Assistance.

3. Plans and Coverage

Available plans, prices, and coverages are published at caribbeanassistance.mx. Caribbean Assistance reserves the right to modify prices and coverages with at least 15 calendar days' notice. Changes will not affect contracts already in force for the paid period.

Travel Plan: coverage valid for the selected days (max 90). Price: MXN $29 per day.

General Individual / Family Plan: monthly, quarterly, semi-annual, or annual coverage. Current prices are shown on the website at the time of contracting.

4. Contracting Process and Payment

  1. The Customer completes the contracting form with their personal and coverage data.
  2. The Customer expressly accepts this agreement and the Privacy Policy.
  3. Payment is processed via Stripe. Caribbean Assistance does not store card data.
  4. Once payment is confirmed, Caribbean Assistance registers the Customer with All Assist and issues the policy number.
  5. The Customer receives confirmation by email with their policy number and service usage instructions.

The contract is perfected when Caribbean Assistance confirms the payment and activates the policy. The service begins on the start date indicated by the Customer.

5. Customer Rights and Obligations

Rights:

  • Receive the contracted services during the policy's validity period.
  • Access the 24/7 emergency line: +52 55 8117 9369.
  • Request information about their policy status.
  • Exercise ARCO rights as set out in the Privacy Policy.

Obligations:

  • Provide accurate and complete information at the time of contracting.
  • Notify any changes in contact information.
  • Use the service in good faith and for its intended purposes.
  • Not assign or transfer the policy to third parties without express authorization.

6. Cancellation and Refund Policy

  • Within 5 business days of payment and provided the service has not been used: full refund of the amount paid.
  • After the first 5 business days or if the service has already been used: no refund. Coverage will remain active until the end of the paid period.

Cancellation requests must be sent to contacto@caribbeanassistance.mx. Approved refunds are processed within 10 business days to the original payment method.

7. Limitation of Liability

  • Caribbean Assistance is not responsible for the quality, timeliness, or outcome of services provided by All Assist.
  • Caribbean Assistance does not guarantee uninterrupted availability of the website or third-party payment systems.
  • Caribbean Assistance's total liability to the Customer, for any reason, shall not exceed the amount paid for the contracted plan.

8. Intellectual Property

All website content (texts, images, logos, designs) is owned by IBEROMEXICANA Q.ROO, S. DE R.L. DE C.V. or its licensors. Reproduction, distribution, or commercial use without prior written authorization is prohibited.

9. Amendments

Caribbean Assistance may modify these Terms at any time. Material changes will be published at caribbeanassistance.mx/terminos with at least 15 calendar days' notice. Continued use of the service constitutes acceptance of the changes.

10. Governing Law and Jurisdiction

This agreement is governed by the laws of the United Mexican States. Any disputes shall be submitted to the competent courts of Mexico City, with each party expressly waiving any other jurisdiction that might apply.

Consumers may also contact the Federal Consumer Protection Agency (PROFECO) to resolve consumer disputes.
